California Proposition 65

What is California’s Proposition 65?

California’s Safe Drinking Water and Toxic Enforcement Act of 1986, also known as Proposition 65 (Prop 65), was enacted and took effect in 1986. The purpose of the law as implied by the name is to protect California’s water supplies and to ensure that residents of California are aware of chemicals that may expose them to cancer causing agents and/or agents that may cause reproductive harm. The law require businesses to give clear and reasonable warnings to California consumers of known products containing a Prop 65 chemical.

Requirements of manufacturers, distributors, retailers, etc

The regulation was recently updated to ensure that the Prop 65 warning message is more specific as to which chemical, if exposed to, is known to the state of California to cause cancer and/or reproductive harm. The new requirements also compels manufacturers, distributors, and retailers to propagate the necessary Prop 65 warnings to California customers, as well as to other trading partner(s) that may sell products into California. Those trading partners include other distributors, retailers, etc.

Covetrus has and is continuously reaching out to manufacturers and other suppliers to obtain a complete list of all products in its offering that require a Prop 65 warning. The warnings are placed on northamerica.covetrus.com on each affected product’s display page. A list of all currently identified products known to require a Prop 65 warning is found in the link below titled Current Covetrus Prop 65 Product List. The link is continuously updated and may change on a daily basis.

Individual Prop 65 warnings for Covetrus-sold products that can be found under on the product display page under California Residents-Proposition 65 Warning on northamerica.covetrus.com. The warning will look similar to the sample warning below:

WARNING: This product can expose you to chemicals including lead which is known to the State of California to cause cancer. For more information go to www.P65Warnings.ca.gov.

Please be aware that any of the products that are part of the list Current Covetrus Prop 65 Product List below require a CA Prop 65 warning to be displayed on a product’s display page if sold via the internet and/or catalog if the product is to be sold to a consumer in the state of California. The labeling associated with the product also need to contain the appropriate CA Prop 65 warning.
